Waiver & Hold Harmless Agreement (Required)

I, along with the stated child(ren) in my care, am participating in activities at BB PINATA LLC, an indoor children’s play space located at 206 W. Jefferson Blvd, Dallas, TX 75208. In consideration for being allowed to enter, use the facilities and equipment, and participate in activities provided by BB PINATA LLC, I hereby agree to the following terms and conditions:

1. Assumption of Risk

I acknowledge and understand that engaging in activities at BB PINATA LLC involves inherent risks, including but not limited to, the risk of physical injury, property damage, illness, and other dangers that may arise from the use of the facilities and equipment.

2. Responsibility for Personal Property

I understand that BB PINATA LLC is not responsible for any loss or damage to personal property, including but not limited to, clothing, electronic devices, or other personal belongings.

3. Health and Safety Measures

I agree to comply with all health and safety measures implemented by BB PINATA LLC, including following posted rules, using safety equipment as required, and reporting any unsafe conditions or incidents immediately to staff. I understand BB PINATA LLC cannot guarantee a germ-free environment, and I assume the risk of exposure to contagious illnesses.

4. Behavior and Supervision

I understand that BB PINATA LLC is a shared play space and is not responsible for supervising my child(ren). I agree that a responsible adult will remain onsite at all times and that all members of my group will behave respectfully and follow staff instructions for the safety and enjoyment of all guests.

5. Food Allergy and Outside Food Policy

I understand that BB PINATA LLC may serve or allow outside food and is not responsible for any allergic reactions, sensitivities, or food-related incidents. I am solely responsible for the food consumed by the child(ren) in my care while on premises.

6. Release and Waiver of Liability

I hereby release and discharge BB PINATA LLC, its owners, employees, agents, representatives, and volunteers from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or the participant(s)/child(ren) in my care while participating in activities at BB PINATA LLC.

7. Indemnification

I agree to indemnify and hold harmless BB PINATA LLC, its owners, employees, agents, representatives, and volunteers from any and all liabilities, claims, actions, damages, costs, or expenses arising out of my or my child(ren)’s participation in activities at BB PINATA LLC.

8. Emergency Medical Treatment

In the event of an emergency, I authorize BB PINATA LLC staff to seek medical treatment on my behalf or on behalf of the participant(s)/child(ren) in my care. I agree to be financially responsible for any costs incurred as a result of such treatment.

9. Photography & Media Release

I grant permission for BB PINATA LLC to photograph or record myself and the child(ren) in my care while on the premises and to use those images or recordings for promotional or marketing purposes. I understand that I may revoke this permission at any time by notifying BB PINATA LLC in writing.

10. Severability

If any part of this agreement is found to be invalid or unenforceable by a court of law, the remaining provisions shall remain in full force and effect.

I have read this Waiver and Hold Harmless Agreement, fully understand its terms, and voluntarily agree to its provisions. I acknowledge that by signing this agreement (via BB PINATA LLC’s online portal or in paper form), I am waiving certain legal rights, including the right to sue, on my behalf and on behalf of the participant(s)/child(ren) in my care. BB PINATA LLC will keep a record of this agreement and will provide a copy upon request.
